Immigration Law Update

Spouses of permanent residents can now apply for their Green Cards immediately. The F2A backlog has been eliminated for August 2013. Same-sex spouses of U.S. citizens, and permanent residents may now apply for Green Cards. A same-sex marriage is considered valid for immigration purposes, it is recognized as legal in the state in which the marriage was celebrated. Thus, as long as the marriage ceremony occurred in a state that recognizes same-sex marriages, couples who reside in states that do not yet recognize same-sex marriages qualify for immigration benefits. Beginning March 4th, 2013, spouses and children of U.S. citizens, who entered the United States without inspection (EWI) will be eligible to apply for a Provisional Waiver by filing their I-601A Hardship Applications within the United States. This new rule benefits millions of aliens, by eliminating the lengthy family separations caused by the previous policy that required immediate relatives of U.S. citizens to file their I-601 applications abroad.
